What is NOM compliance, and why do I need it for Mexico?
NOM is an acronym for official Mexican law in Spanish and is mandatory for all items being exported and sold into Mexico. Failure to comply can cause delays, fines, having products pulled from shelves, or worse.
What is a Constancia?
A Constancia is a legal document issued by verification agencies that validate your packaging is compliant with the applicable NOM based off your type of item. For example, the NOM standard for foods and beverages is NOM-051 so if you selling a food item to Mexico, you will need a Constancia that validates its compliance with the NOM-051 standard. The Constancia is only issued if its compliant with the entire labeling standard outlined in the NOM.
How long is a Constancia valid?
Constancias do not have expiration dates, however any changes made to your layout including changes to information that is not part of the mandatory NOM requirements will require you to secure a new Constancia since the Constancia needs to be an exact match with the packaging and/or manual being used for Mexico. The other situation that could trigger a new Constancia is when the regulations change and there is an updated NOM standard applicable which is not common for most NOMs, but some NOMs, including NOM-051, have been updated several times in the last 10 years.
What types of products require NOM testing and certification?
Products that use electricity or batteries—such as electronics, appliances, or electrical tools—require NOM-001 or NOM-003 certification. This includes submitting product samples and supporting documentation for testing. NOM certification is also applicable for other product categories, including chocolate, wireless frequencies, items that operate using liquid propane or natural gas and water efficiency. How long is a certificate valid?
Most NOM certificates are valid for one year from the time they are issued. Even if you sell the same exact item for more than a year, you will need to go through the complete NOM testing and certification process including submitting new samples.
